Contract

        The undersigned BUYER hereby agrees to purchase fromSELLER           ____ puppy(ies).  All puppies are sold as is for the purpose of a pet and no warranties or guarantees, whether express or implied, other than that stated herein are provided.

 

1.                  The total purchase price for the puppy(ies) is $______________, to be paid as follows:  A deposit of $________ is required to be paid  …  The balance of the purchase price shall be paid in full by __________.  The deposit is non-refundable and will be forfeited by BUYER upon cancellation of this contract.

 

2.                  All puppies will be sold having current shots up to 8 weeks, deworming and health certificate from a licensed veterinarian.  Records confirming these items are provided with each puppy sold.

 

3.                  BUYER shall secure an examination of the puppy by a licensed veterinarian within three (3) business days of taking possession of puppy, otherwise BUYER shall be barred from asserting any claim of illness or defect in the puppy.  If BUYER obtains an examination within the 3 day time period and a licensed veterinarian determines the puppy suffers from a terminal illness or defective condition which requires the puppy to be euthanized, BUYER must submit to SELLER within thirty (30) days of the purchase date a copy of the veterinarian’s records, along with an Affidavit from the veterinarian setting forth the veterinarian’s license information and the diagnosis and prognosis for the puppy.

 

4.                  SELLER will replace a puppy within one year of purchase date that has been diagnosed by a licensed veterinarian as suffering a congenital or hereditary defect in the heart, lungs or liver which is terminal, if and only if BUYER provides SELLER with the following items:

a)      the puppy’s registration papers;

b)      copies of the veterinarian’s records and the Affidavit referenced in paragraph 3 hereinabove;

c)      a verified certificate from a licensed veterinarian that the puppy received all vaccinations and treatment prescribed for proper veterinary care;

d)     a telephone call from the veterinarian.

In the case of death, an autopsy must be performed by a licensed veterinarian and an Affidavit stating the cause of death is required in addition to the above.

 

BUYER shall be solely responsible for all shipping costs.  BUYER understands and acknowledges that replacement puppies can take up to one year to be available.  No puppies will be replaced that are euthanized because of pneumonia, hypoglycemia, coccidiosis, giardia, dehydration, hernias or stress resulting from excessive exercise, lack of exercise, being over weight or under weight or pre-mature breeding.

 

5.                  BUYER hereby acknowledges and agrees that SELLER will transfer the puppy to the delivery agent for shipping.  At the time of transfer, all records confirming the healthy condition of the puppy, vaccinations and deworming will be provided.  SELLER shall not be responsible for any change in condition of the puppy after transfer to delivery agent.  BUYER understands that delay in shipment is possible and any such delay shall not create any right of BUYER to cancel this contract or entitle BUYER to any refund of monies paid.

 

6.                  BUYER may cancel this contract within ten days prior to the scheduled shipment date by written notice to SELLER.  If BUYER cancels prior to ten days before the scheduled shipment date, BUYER forfeits the deposit.  If BUYER cancels for any reason later than ten days before the scheduled shipment date, BUYER forfeits the deposit and shall pay to SELLER a cancellation fee equal to 20% of the total purchase price.  In the event the puppy fails a vet check and is unable to be shipped, BUYER shall have the option of waiting for that puppy to be certified for shipment, choosing another puppy, or a complete refund of all monies paid, including the deposit.

 

7.                  This contract is written and deemed executed in the State of Missouri.  The parties hereby agree that the exclusive jurisdiction and venue for all disputes arising hereunder shall be in the Circuit Court of Boone County, Missouri.
